A contemporary two-bedroom apartment in Angmering-on-Sea. There are two spacious bedrooms, a single room with a pull out trundle bed (5 foot trundle, suitable for a smaller person, please request if you would like the trundle bed made up) and a double bedroom; both bedrooms lead directly out to the Courtyard Garden; a lovely area to relax after a day at the beach.

The Court fined the hosts almost £1500 for breach of contract/right to quiet enjoyment, black mould

I had to take the hosts to the small claims court to obtain compensation. Having to go to trial was a long and stressful process but I wanted to wait until I had received an authoritative court judgement before submitting a review. Following a hearing, the Judge ruled that “between 13 November and 4 December 2021 the Defendants carried out loud, intrusive and non-essential maintenance works, without reasonable notice to the Claimant, in breach of the Claimant’s right to quiet enjoyment.” The material I submitted to the Court set out how the hosts had spoiled and disturbed our stay by using loud electric sanders; by waking us up early at weekends by using loud electrical equipment above our bed; and by doing lots of maintenance work on the external woodwork, often directly in front of The Loft’s extensively glazed living/dining room and master bedroom which undermined our privacy and put us constantly on edge. Although they did all the work themselves, they did not inform us about this work before we booked, before we arrived, or before they did it. The Judge also found that “during the Claimant’s occupation of the property, it suffered from a defective fridge freezer (which caused some of her food to spoil) and from black mould spotting around a door, in the kitchen and in the second bedroom (which was not caused by the Claimant’s use of the property)”. The Judge ordered the hosts to pay me compensation of almost £1500. The hosts paid the compensation but never apologised. When I reported the Court’s judgement and fine to their agent Henry Adams, the Holiday Cottages’ Director merely responded “Thank you … for the update”! This was not surprising. I had recorded problems and made complaints to their agent during the contract, but in my view Henry Adams’ Holiday Cottages Director and Henry Adams Chief Executive handled these and my subsequent complaints poorly. Henry Adams also made an already painful experience worse. After our stay, Henry Adams deducted extra rent over and above the written contractual terms from our security deposit (Which? Legal Advice Services advised that this constituted their own breach of contract) and I had to send several emails about this before they recognised that there was a potential problem and paid us back. Henry Adams also made false allegations relating to our stay that were not true, that they provided no evidence for, and that they would not answer even basic questions about so did not allow me to fully understand what they were alleging. I emailed the Chief Executive what Citizens Advice told me about this: Henry Adams either had to prove their allegations or retract them. Henry Adams failed to do either. The hosts relied on these false allegations as part of their Defence to the Court against my claim. I submitted a substantial amount of material to the Court that I believe demonstrated that Henry Adams’ allegations were patently untrue.

We spent a wonderful week in July in the Loft, located just 50m from the gravel beach. With 6 sunny days we were quite lucky. As we cooked every day, just a dish washer was missing (but we knew about that before) - and sharp knives!
